Rule 48
Duties, Duties and Powers of Occupational Safety and Health Inspectors
(1) In relation to occupational safety and health, the duties, duties and rights of the senior occupational safety and health inspector or occupational safety and health inspector shall be as follows:-
(a) To check from time to time whether the employer has fulfilled the obligations required to be fulfilled according to rules 39, 40, 41, 42 and 44, (b) boilers, pressure vessels and other potentially fatal dangerous machines in the work place shall be inspected and operated once a year to be allowed to operate for a period of one year,
(c) To check the health and safety of the house, land, and plant used by the employer for employment, to take samples of the prepared and semi-prepared items used there, to check and if any improvements are needed, to order the manager to make improvements,
(d) If there is any risk from the point of view of health and safety at the workplace, to order the employer to make necessary arrangements to eliminate such risk immediately.
(2) If it appears that the use of any substance necessary for the production process or service of the establishment may harm the health of the workers, the department or office may collect a sample of such substance from the designated officer and have it tested by an expert. If there is any fee for such test, such fee shall be borne by the employer.
(3) If it is proved from the sample test collected according to sub-rule (2) that such substance may have an adverse effect on human health, the Government of Nepal may give instructions to prohibit the use of such substance.
